This document contains the Privacy Policy of Pro Backup BV, a company whose registered office is at Kroonwinningstraat 113, 3500 Hasselt (Belgium). Pro Backup BV is the legal owner of the Pro Backup service, accessed via www.probackup.io. Pro Backup is responsible as the controller of your personal data as explained in this Privacy Policy.

To whom does this apply?

The personal data we process subject to this Privacy Policy, relates to

  • visitors of our website www.probackup.io
  • staff or representatives of organizations and companies with whom we have business relationships,
  • natural persons with whom we have business relationships in their own name, or 
  • natural persons with whom we have business relationships, on behalf of a sole proprietorship.

Which personal data do we process?

Depending on your designation above, we process

  • your contact and identification data, including your name, address, e-mail address, phone number, and company position,
  • when we have business relationships with you as a natural person, we also process your billing information (VAT, billing address) as personal data, and
  • technical data in connection with the use of our services and website.

Why do we process your personal data?

We process your personal data for various purposes. Below, you will find an overview of those purposes as well as the legal ground on which we base ourselves to legitimize such processing.

  • Customer management – to provide you with access to our services, manage payments and accounting, as well as other contractual obligations (such as account management), we process your contact and identification data and billing information.

    For customer management, the processing is necessary for the execution of our contractual relationship with you.

    However, if you are a staff member or representative of an organization or company, the processing of your data is based on our legitimate interest to do business.
  • Supplier Management – to manage and receive services from you or your company as a supplier, we process your contact and identification data and billing information. This is used for managing the services or goods you provide, and to manage payments and accounting.

    For customer management, the processing is necessary for the execution of our contractual relationship with you.

  • Prospects – we may process your contact and identification data where we deem that your services could benefit our company.

    The processing of your data as a prospective contract partner is based on our legitimate interest to do business.
  • Marketing – to market our services, we may send messages to you or your company informed about the tools, products and solutions we offer. For this purpose, we process your contact and identification data.

    For our marketing efforts in relation to you as an existing customer, we base ourselves on our legitimate interest to market the same or similar services to the ones for which we have a contractual relationship. Please note that you can decide at any time to stop receiving such messages by modifying your marketing preferences on your account page (opt out).
  • Safety and security – To prevent, detect and combat fraud or other illegal activities, we may process your contact and identification data, billing information, and technical information.

    For safety and security, we rely on our legitimate interest in keeping our services safe and secure.
  • Legal proceedings – we may process your contact and identification data, billing information, and technical information to defend ourselves in legal proceedings.

    To process this personal data, we rely on our legitimate interest in using your personal data in these proceedings.
  • Legal obligations – to comply with our legal obligations or to comply with a reasoned request from competent authorities or government bodies, including competent data protection authorities, we may process your contact and identification data, billing information, and technical information.

With whom do we share your personal data?

In principle, we do not pass on your data to third parties other than when this is absolutely necessary for the purposes of the processing detailed above. In those cases, your personal data may be shared with our third-party service providers (processors), such as external accounting firms, hosting providers, or other IT service providers. In that case, we impose on those third parties the necessary obligations to process your personal data in compliance with the applicable data protection law.

When we do share your personal data with other parties it will generally be when this this is required by law .

How long do we keep your personal data?

Your personal data will only be processed for as long as necessary to achieve the purposes described above. As a general rule, we will delete or de-identify your personal data when it is no longer useful for its intended purpose. Please note that your personal data will never be deleted or de-identified if we have a legal or regulatory obligation or a court or administrative order preventing us from doing so.

When your personal data is processed on the basis of our agreement with you, your personal data will remain stored for the entire duration of the agreement and five years thereafter.

When your personal data is processed for marketing purposes, it will remain stored for the entire duration of our contractual relationship and two years thereafter, or until you unsubscribe from receiving our marketing communications.

How do we keep your data secure?

We attach great importance to the safety and security of your personal data. To that end, we take the necessary appropriate technical and organizational measures. These measures range from physical access policies and procedures to more technical actions on our computers and servers.

Do we transfer your personal data to third countries?

In principle, we do not pass on your data to third countries, i.e., countries outside the European Economic Area (EEA). If we transfer your personal data, we will ensure that this is done to recipients in a country whose level of protection has been found to be adequate by the European Commission, or we will conclude the European Commission Standard Contractual Clauses (SCCs) with those recipients. Where required we will supplement those SCCs with additional measures to ensure an essentially equivalent level of data protection as in the EEA.

Right of access and inspection: You have the right to access your personal data, as well as the use we make of your personal data, at any time, free of charge.

Right to correction, deletion, and limitation: You have the right to request us to correct, supplement, delete or limit to processing of your personal data. Keep in mind that certain services and products are no longer available when personal data is removed.

Right to object: Where we process your personal data on the basis of our legitimate interest, you have a right to object to the processing of your personal data for serious reasons related to your specific situation.

Right to free data transfer: You have the right to obtain and / or transfer your personal data processed by us in a structured, commonly used and machine-readable form.

Right to withdraw consent: Insofar as the processing is based on your prior consent, you have the right to withdraw that consent.
